1. Who we are

Javid Network Watch ("the Service", "we", "us") is a non-commercial website. For general questions, write to [email protected]. For legal questions and takedown notices, write to [email protected]. For data protection, write to [email protected].

2. Acceptance

These terms apply when you use the Service. If you do not agree with them, do not use the Service.

3. What you can do

You can view the Service and use its information for personal, research, journalistic, educational and other non-commercial purposes. When you publish information from the Service, name Javid Network Watch and the original data provider.

4. What you must not do

You must not use the Service in a way that breaks the law, or that harms, harasses or puts any person in danger.

You must not try to disrupt, overload or get unauthorised access to the Service or its servers. Automated requests must stay at a rate that does not degrade the Service for other people.

You must not present data from the Service as your own original measurement.

5. Data from other providers

Most data on the Service comes from other organisations. Their terms continue to apply to that data and to figures derived from it. Some of these terms do not allow commercial use, and some require you to share derived work under the same licence. The Acknowledgements page lists each provider and its terms.

6. Intellectual property

We own the source code and design of this website. They are not published under an open-source licence, and all rights are reserved.

Our own written text is available under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). This licence does not cover measurement data or figures that come from other providers. Section 5 applies to them.

7. No warranty

We provide the Service free of charge and "as is". The measurements are indicative, not authoritative. To the extent that the law allows, we give no promise that the Service is accurate, complete, available without interruption or suitable for any purpose. The Disclaimer explains the limits of the data.

8. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that the law does not allow us to limit or exclude.

If you are a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.

Subject to the two paragraphs above, we are not liable for any loss that you could not reasonably foresee when you started to use the Service, or for any loss that comes from your decision to rely on the data. If you use the Service for business purposes, we are not liable for loss of profit, revenue, business or data.

9. Misuse

If you use the Service for business purposes and you break section 4, you agree to cover the reasonable costs and losses that we suffer as a direct result of that breach. This section does not apply to consumers.

10. Links to other sites

The Service links to websites and tools that other people run. We do not control them and we are not responsible for their content, their safety or their privacy practices. A link is not a recommendation.

11. Changes and availability

We can change, suspend or stop the Service at any time. We can change these terms. The date at the top of this page shows the latest version. The terms in force when you use the Service apply to that use.

12. Law and courts

The law of England and Wales governs these terms. The courts of England and Wales have jurisdiction, but if you are a consumer and you live elsewhere in the United Kingdom or in another country, you can also bring a claim in the courts where you live, and you keep the protection of the mandatory law of that place.

13. Other terms

If a court finds that part of these terms is not valid, the other parts stay in force. If we do not enforce a term at once, we do not give up our right to enforce it later.
